When a problem in a building affects several owners, the first step is to find out what is causing it and who has to pay for the repair. An expert report puts this in writing on technical grounds and can be used to claim against the builder, the insurer or another owner, or to defend the association in court.
When does a homeowners’ association need an expert?
- Damp and leaks: from roofs, terraces, downpipes, façades or garages. We identify the source and whether it is a common or a private element.
- Damage between neighbours: leaks from one flat to another, or works by one owner that affect common elements or other homes.
- Construction defects in new or refurbished buildings: cracks, falling material, waterproofing or installation problems. Spanish building law (LOE) sets 1, 3 and 10-year periods to claim, depending on the type of defect.
- Poorly executed works: façade, roof or lift works that do not match what was agreed.
- Insurance claims: when the association’s insurer rejects or undervalues a claim.
- Valuations: the real cost of a repair, of a special levy or of the damage suffered.
How we work
- The association or the property manager sends us the case by email, WhatsApp or through the form, with photos and any documents available.
- We review it and send you a quote.
- We inspect the building and write the expert report.
- If the case goes to court, we defend the report before the judge.
Who can commission it?
It is usually commissioned by the president or the property manager after the owners’ meeting agrees to it. An individual owner can also commission it when the problem affects them personally.
